Terms & Conditions

These Terms & Conditions govern the agreement between MZ Moments (“the Photographer”) and the client (“the Client”).

By booking a session with MZ Moments, the Client acknowledges and agrees to these Terms & Conditions. If you have any questions or require further clarification, please contact us prior to your session.
1. The Booking Deposit / Payments

To secure your session date and time, a non-refundable booking deposit is required at the time of booking. The deposit amount varies depending on the package and services you are booking. The booking is not confirmed until the deposit is received.

Any session fee balance (where applicable) is due on the day of your photo session – no exceptions.

2. Unretouched, RAW Images

MZ Moments does not provide raw or unedited images. All photography packages include only professionally retouched images. The number of retouched images included will depend on the specific package chosen.

3. Additional Images

If the Client wishes to purchase additional retouched images beyond what is included in the package:

  • Individual images can be purchased at £15 per image.
  • If 10 or more additional images are purchased, the cost is reduced to £10 per image.
4. Choosing Final Photos for Retouching

After the photography session, the Client will receive an online gallery containing the best unretouched images within two weeks. The Client has 30 days from the date the gallery is sent to select the final images for retouching. Failure to make a selection within this timeline may result in delays or additional charges.

5. Editing Requests

The Client may provide specific editing preferences within one week of receiving the online gallery. Additional editing requests beyond this timeframe will incur extra charges. Basic editing includes:

  • Skin retouching (e.g., removal of small blemishes).
  • Enhancement of colours and backgrounds.

Editing does not include significant alterations, such as changes to clothing, makeup, or appearance. It is the Client’s responsibility to ensure readiness before the session.

6. Image Delivery

All images will be delivered digitally via download links. The Client is strongly advised to promptly back up the images to a secure storage device, as digital media has a limited lifespan. The Photographer is under no obligation to retain copies of the images after they have been delivered.

7. Session Punctuality

The Client is encouraged to arrive 10-15 minutes before the scheduled session time. Late arrivals will result in reduced session time. Excessive early arrivals may disrupt other appointments, so please adhere to the recommended timing.

8. No Shows

If for any reason after receiving your confirmation, you fail to attend your photo shoot appointment, you forfeit your booking retainer fee – This is to cover the cost of the time already booked with the photographer.

9. Cancelling / rescheduling

If you wish to cancel an appointment you will forfeit your booking fee.

Sessions may be rescheduled with at least 48 hours notice at no additional cost, up to two times. Any further reschedules or changes will incur a £50 rescheduling fee.

10. Editing and Retouching Limitations

The Photographer is not responsible for:

  • Wrinkled clothing, dirty shoes, poorly applied makeup, or self-tanning errors.
  • Any other issues that the Client is expected to address before the session.

Editing does not include drastic alterations to appearance and is limited to enhancing the quality of the photos.

11. Copyright

All images created by MZ Moments are the intellectual property of the Photographer. Under the Copyright, Designs and Patents Act 1988, the Photographer retains all rights to the images. Clients may reproduce, print, or display the images for personal use only. Any other usage requires prior written permission.

12. Force Majeure

In the event of unforeseen circumstances such as illness, accident, or emergencies that prevent the Photographer from fulfilling their duties, all efforts will be made to find a suitable replacement. If rescheduling or finding a replacement is not possible, the Client will receive a full refund of payments made. The Photographer’s liability is limited to the refund of payments and does not extend to further damages or compensation.

13. Liability
  • The Photographer is not responsible for indirect losses or third-party claims due to delays or issues during the session.
  • Liability for defective work, if any, is limited to rectifying the defect.
  • The Photographer is not responsible for personal accidents or injuries during the session. Clients and their guests participate at their own risk.
14. Right to Withdraw

The Photographer reserves the right to withdraw from an agreement due to:

  • Significant changes to agreed terms, locations, or times.
  • Non-cooperation from the Client (e.g., missed meetings, non-payment, or late payment).
  • Late arrival at sessions or other disturbances to the agreed plan.
15. No photography or videography by Clients

There is strictly no photography or videography in any form (including the use of mobile phones or other devices) permitted during the session, other than that carried out by the Photographer. Anyone found doing so will be asked to leave immediately and will forfeit their session fee to cover the Photographer’s time and work carried out.

16. Display

All persons taking part in photos, and/or group photographs agree that you do so voluntarily and on the basis that your image may be displayed on the site or website and in printed publications, and may be used by us for promotional purposes. Due to the number of people involved in a group photograph, you will not be able to withdraw your consent once the photograph has been taken.

Please advise in writing if you do not want your images used in this way.

The Photographer reserves the right to amend these Terms and Conditions without prior notice.
